1. Introductory Provisions

1.1 These Terms & Conditions ("T&Cs" or the "Agreement") govern the rights and obligations related to the use of services provided by Mindwave Training Ltd, a company registered under the laws of Cyprus, operating under the brand name Fundingrock. These services are accessed through fundingrock.com or other authorized channels.

1.2 By registering on the Website or using the Services, you (hereinafter "you," "your," or the "Client") enter into a contract with the Company and agree to these T&Cs.

1.3 The Services provided by the Company do not constitute investment services or advice. The Company does not offer trading guidance, and any statements by its employees shall not be construed as investment recommendations.

1.4 Your personal data is processed according to the Privacy Policy.

2. Definitions

2.1 "Client" refers to any user of the Services.

2.2 "Dashboard" is the platform where clients access their accounts and trading performance.

2.3 "Evaluation Phase" refers to the process in which Clients must meet specific profit and risk management criteria within a simulated trading environment.

2.4 "Funded Phase" refers to the stage where a Client gains access to a funded account after successfully completing the Evaluation Phase and meeting KYC requirements.

2.5 "Know Your Client (KYC)" refers to the verification process required before accessing the Funded Phase.

2.6 "Trading Platform" refers to a third-party electronic interface for simulated trading.

2.7 "Website" refers to fundingrock.com.

3. General Terms

3.1 Clients must provide accurate personal details during registration. The Company reserves the right to verify identity and deny service for inconsistencies.

3.2 The Services are available to individuals over 18 years of age who reside in jurisdictions where the Services are permitted.

3.3 Clients must update their information in case of changes. Misrepresentation of residency, use of VPNs, or other means to bypass restrictions is a violation of these T&Cs.

3.4 The Company may suspend or terminate Services if the Client is found to be involved in fraud, financial crime, or is subject to sanctions.

4. Services

4.1 The Services include simulated trading, analytical tools, training materials, and access to the Dashboard.

4.2 Trading conducted within the Evaluation Phase is simulated and does not involve real money. No Client shall receive compensation for profits made during this phase.

4.3 Clients can purchase a Challenge through the Dashboard, and upon successful completion, may advance to the Funded Phase.

4.4 Clients are responsible for acquiring the necessary hardware, software, and internet connection to access the Services.

5. Fees

5.1 Access to the Evaluation Phase requires payment of a fee ("Fee").

5.2 The Fee varies based on account type and evaluation parameters.

5.3 Refunds are available within 14 days of purchase, provided no trades have been executed. Refund requests must be submitted via [email protected].

5.4 Clients are not entitled to refunds if they have started trading or violated these T&Cs.

6. Payment Terms

6.1 Fees are payable in USD or other supported currencies. Exchange rates applied by payment providers may vary.

6.2 Taxes are included in the Fee, and Clients are responsible for their own tax obligations.

6.3 Payment methods available are listed on the Website.

7. Dashboard

7.1 Each Challenge is independent; Clients cannot merge capital, rules, or data between Challenges.

7.2 Clients must keep login credentials secure. The Company is not responsible for unauthorized account access.

7.3 The Company may conduct maintenance or upgrades that may temporarily disrupt service without prior notice.

8. Term; Termination; Suspension Of Services

8.1 These T&Cs remain in effect as long as the Client uses the Services.

8.2 Clients may request account termination through the Dashboard; no refunds will be granted.

8.3 Unauthorized use of the Services is a material breach and may result in account suspension or termination.

9. Rules And Parameters

9.1 Clients must follow ethical trading practices and comply with risk management rules.

9.2 The Company reserves the right to monitor and audit trading activities.

10. Order Placement; Timing & Price

10.1 Clients must avoid placing trades within two minutes before or after major economic announcements.

10.2 Exploiting off-market prices or engaging in collusion is prohibited.

11. Evaluation Phase

11.1 Upon payment, Clients receive login credentials for the Trading Platform.

11.2 Clients who meet all Evaluation Phase requirements may proceed to the Funded Phase upon completing the KYC process.

12. Use of Website and Services

12.1 All content on the Website is protected by copyright. Clients may not copy, modify, or distribute it.

12.2 Circumventing geographical restrictions or using automated tools to manipulate the Services is prohibited.

13. Disclaimer

13.1 The Services are provided "as is." The Company makes no guarantees about profitability or market performance.

13.2 The Company is not responsible for losses arising from technical issues, regulatory changes, or market conditions.

14. Communication

14.1 The Company will communicate with Clients via email or the Dashboard.

15. Right To Withdraw

15.1 Clients may withdraw from these T&Cs within 14 days of execution, provided no trades have been placed.

16. Complaints

16.1 Clients may submit complaints to [email protected] for resolution.

17. Governing Law & Jurisdiction

17.1 These T&Cs are governed by the laws of Cyprus. Disputes shall be resolved in the courts of Cyprus.

18. Final Provisions

18.1 If any part of these T&Cs is found invalid, the remaining provisions remain effective.

18.2 The Company reserves the right to amend these T&Cs at any time, with changes communicated via the Dashboard or email.

19. Behaviour Policy

19.1 Clients must engage respectfully with the Company's staff. Abusive, threatening, or disruptive behavior will not be tolerated.

19.2 The Company reserves the right to suspend or terminate accounts for inappropriate conduct.
